Terms of Use
These are the Terms of Use for the Your City: Your Space Forum which must be followed at all times by all users.

Melbourne City Council may change these Terms of Use at any time without notice. By accepting the Terms and Conditions you agree to abide by any new or modified Terms of Use.

1. Forum Rules
You must follow these rules:
  • Adult Content – No reference to or images or videos containing nudity or sexual activity.
  • Child Safety – No content that exploits children.
  • Hate Speech - No content that defames, harasses, threatens, abuses, offends or is not constructive (i.e. you can disagree with someone else provided you do so in a respectful way). No content that promotes hate or violence based on race, ethnicity, religion, disability, gender, age, sexual orientation/gender identity or any other form of discrimination.
  • Crude Content – No swear words and don’t post content just to be shocking or graphic.
  • Copyright – Don’t infringe copyright or other intellectual property.
  • Relevance – Keep the Forum about safety issues. Do not use the Forum for promotion or commercial purposes
  • Privacy – Do not post personal information on the Forum.
  • Spam – Do not spam the Forum or copy/paste from other websites.
  • Impersonating others – Don’t mislead users by pretending to be someone else or pretending to represent an organisation that you do not. 
  • Be above board – Comply with the law at all times.
2. Your Posts and Membership
If you violate any of the Terms of Use at Council’s absolute discretion, Council may without notice modify, withhold or delete any material posted by you and/or suspend or terminate your membership. You agree that should Council or Council’s agents take such action, no correspondence will be entered into and there is no right of appeal or review.
 
3. Security and corruption
You agree and understand that you are responsible for maintaining the confidentiality of your password to access the Forum.
 
You agree that you will be solely responsible for all activities that occur under your login and are responsible for the consequences of your actions.
 
You understand that by using the Forum you may be exposed to content that you may not agree with and that, in this respect, you use the Forum at your own discretion.
 
You agree that you will not transmit viruses or malicious programs through the Forum.
 
You will not attempt to gain illegal access to any component of the Forum nor will use the Forum for any illegal or improper purpose such as tampering with or modifying the Forum website.
 
4. Limitation of Council’s liability
The City of Melbourne does not make any representation or warranty about the accuracy, reliability, currency or completeness of any material contained on the Forum or any Linked Web Site.

You should exercise your own independent skill and judgement before relying on any material contained on the Forum.  This website is not a substitute for independent professional advice and users should obtain any appropriate professional advice relevant to their particular circumstances.

You agree that Council including its employees and agents will not be liable to you for any damage which may be caused to you or any loss suffered by you arising from or in connection with your use of the Forum such as relying on the completeness and/or accuracy of material contained on the Forum.

Council will not be liable to you for any changes made to the Forum or any permanent or temporary cessation in the provision of the Forum or any of its features including the deletion of, corruption of or failure to store any content and other communications data maintained or transmitted by or through your use of the Forum.
 
Your use of the Forum is at your own risk and Council accepts no responsibility should you be offended by the Forum or should your use of the Forum cause any interference, loss, damage or disruption to your computer system.
 
5. Use of Information
By posting content on the Forum, you agree that such information or material is and will be treated by the Council as non-confidential. You grant Council and its employees and agents a perpetual, irrevocable, worldwide, royalty free and non-exclusive licence to use such information or material without restriction. You acknowledge that this licence allows the Council to, amongst other things, edit, reformat, reproduce, publish, communicate to the public and make an adaptation of any information or material submitted by you and that Council may use same in (without limitation) any of its promotional, advertising and marketing activities in Australia and overseas.
 
6. Links to other websites
The Forum may contain links to other web sites (Linked Web Sites). Those links are provided for convenience only and may not remain current or be maintained. We are not responsible for the content or privacy practices associated with Linked Web Sites. Linked Web Sites are not necessarily endorsed, approved or recommended by Council.
 
7. Indemnity
You agree to indemnify Council including its employees and agents against all claims, demands, damages, costs, penalties and liabilities caused or connected to your use of the Forum.
 
8. Jurisdiction
The Forum is governed by the laws in the State of Victoria, Australia.
 
9. Copyright
You must not reproduce, adapt, upload to a third party, link to, frame, perform in public, distribute or transmit in any form content on the Forum without specific written consent from the copyright owner and where the Council is not the copyright owner, the Council.
